The U.S. Division of Justice unsealed an indictment charging Tremendous Micro Laptop (SMCI) co-founder Yih-Shyan “Wally” Liaw and two associates with smuggling $2.5 billion in Nvidia (NVDA) AI servers to China.

SMCI shares plunged 28% whereas Nvidia fell 4.8% because the highest-profile U.S. AI chip export enforcement case rattled markets.

How the Alleged Scheme Labored

In response to the DOJ, Liaw used an unnamed Southeast Asian shell firm as a faux finish person.

The corporate reportedly positioned huge orders for SMCI servers outfitted with restricted Nvidia GPUs, together with B200 and H200 sequence chips, which have been banned for export to China since 2022.

SMCI positioned Liaw and Chang on administrative depart and acknowledged the alleged conduct “is a violation of the Firm’s insurance policies.”

The corporate itself will not be named as a defendant and says it’s cooperating with authorities.

The case now sits with Choose Edgardo Ramos within the Southern District of New York.

Whether or not prosecutors pursue extra fees in opposition to SMCI as an entity, or whether or not Nvidia faces additional provide chain scrutiny, will form AI chip coverage debates for months.
